RKUHAP must cover women in conflict with law: commission

Jakarta (ANTARA) - The National Commission on Violence against Women (Komnas Perempuan) has highlighted the need to incorporate the rights of women in conflict with the law in the draft Code of Criminal Procedure (RKUHAP).

“The rights cover women’s position as victims, witnesses, suspects, defendants, and convicts,” chair of Komnas Perempuan, Maria Ulfah Anshor, said in Jakarta on Saturday.

According to Anshor, the existing criminal procedure code offers no protection for the rights of women in conflict with the law, including provisions to fulfill gender-specific needs.

“In many cases, women victims of violence are still treated merely as evidence (rather than individuals), while the state has not yet addressed the aspects of justice and recovery for the impact of the crimes that they have experienced,” she said.

Komnas Perempuan has also urged the House of Representatives (DPR) to guarantee meaningful involvement in all stages of deliberations on the RKUHAP, both in terms of process and substance.

This is crucial so that the criminal procedure code reflects the experiences and needs of women seeking justice and addresses the structural issues that women face in the criminal justice system.

The RKUHAP is currently undergoing the formulation and synchronization process in the DPR, which has been made open to the public to submit their input.
